Resource Membership Terms & Conditions

The Resource Membership is intended to help businesses that help people grow to get more exposure than they would on their own. This is achieved by co-operative marketing initiatives so the Resource Members benefit from the marketing activities of Choose the 'Tude and learn about marketing in the process.

The intention for customers is to profile innovative businesses and their products so they can make informed decisions about service providers.

The big intention for the Choose the 'Tude Resource Centre is to raise awareness of personal responsibility and choice so more people make positive choices and make their goals a reality.

These Terms, together with any Additional Terms, form a legally binding agreement between you and Choose the 'Tude in relation to your use of the services.

In order for Choose the 'Tude to set up your links and web page, first you must agree to the Terms. You can accept the Terms by completing the application form. Upon acceptance of your application you will be registered as a Resource Member and your information will be posted as agreed.

Choose the 'Tude agreements
Upon acceptance of the Terms and approval of your application, Choose the 'Tude will produce the web page using your logo and information (provided by you, although text may be edited for marketing effectiveness). You will have the right to approve all written text prior to the web page going live.

Choose the 'Tude reserves the right to reject an application based on the applicant not meeting the required standards, the product or service does not meet our criteria or a conflict of interest, you are not of legal age to form a binding contract, you or any member of your business has been prosecuted for unsafe internet behaviour or misleading information, or any other just reasons.

Resource Members must represent the Choose the 'Tude brand as per the branding guidelines only. No distortion or misrepresentation will be permitted.

Choose the 'Tude has subsidiaries and affiliated legal entities (Subsidiaries and Affiliates). Sometimes, these companies may be providing the services to you on behalf of Choose the 'Tude. You acknowledge and agree that Subsidiaries and Affiliates will be entitled to provide the services to you.

Choose the 'Tude is constantly innovating in order to provide the best products, services and experience to its customers. You agree that the form and nature of the services which Choose the 'Tude provides may change from time to time without prior notice to you. You will be informed of any changes to services affecting Resource Members directly.

Your agreements
You agree to provide accurate, correct and up to date information in order to represent your business, products and/or services in an honest manner.

Unless you have been specifically permitted to do so in a separate agreement with Choose the 'Tude, you agree that you will not reproduce, duplicate, copy, sell, trade or resell the services or information provided to you for any purpose.

You agree that you are solely responsible for, and that Choose the 'Tude has no responsibility to you or to any third party for any breach of your obligations under the Terms and for the consequences including any loss or damage which Choose the 'Tude may suffer of any such breach.

You understand that all information (such as data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images) which you may have access to as part of, or through your use of, the services are the sole responsibility of the person from which such content originated. All such information is referred to below as the Content.

You agree to honour the intellectual property rights of any information, text, pictures, downloads, audio files, photographs and videos you have access to during this service. This means you may not modify, rent, lease, loan, sell, distribute or create derivative works based on this content (either in whole or in part) unless you have been specifically told that you may do so by the owners of that content in writing.

You acknowledge and agree that Choose the 'Tude own all legal right, title and interest in and to the services, including any intellectual property rights which subsist in the services (whether those rights happen to be registered or not, and wherever in the world those rights may exist). You further acknowledge that the Services may contain information which is designated confidential by Choose the 'Tude and that you shall not disclose such information without Choose the 'Tude prior written consent.

Distinctive brand features such as logos, domain names, trade marks and other features may only be used with the permission of Choose the 'Tude and in compliance with the Choose the 'Tude branding specifications.

You retain copyright and any other rights you already hold in content which you submit, post or display on or through, the services.

Resource Memberships are for a 12-month term, after which you can choose to renew or end your membership. Early termination can only happen with mutual agreement between the two parties.

Memberships are non-transferrable and non-saleable to another third party.

Choose the 'Tude may at any time, terminate its legal agreement with you if you have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms); or Choose the 'Tude is required to do so by law (for example, where the provision of the services to you is, or becomes, unlawful); or Choose the 'Tude is transitioning to no longer providing the Services to users in the country in which you are resident or from which you use the service; or the provision of the services is, in Choose the 'Tude’s opinion, no longer commercially viable.

Choose the 'Tude do not warrant to you that your use or application of the marketing content will meet your requirements, or the web presence will be uninterrupted, secure or free from error.

Choose the 'Tude does not take any responsibility and is not liable for any product, service and/or advice provided by any Resource Member.
